१९९२ मध्ये इंद्रा सहाणी खटल्यामध्ये सर्वोच्च न्यायालयाने ५० टक्के आरक्षण मर्यादा घालून दिली होती. नऊ सदस्यीय खंडपीठाने हा निकाल दिला होता. त्यामुळे मराठा आरक्षण देण्यासाठी करण्यात आलेल्या कायद्याच्या घटनात्मक वैधतेला आव्हान देण्यात आलेले होते. या याचिकांवरील सुनावणी पूर्ण झाली झाल्यानंतर न्यायालयाने निकाल राखून ठेवला होता. अखेर सर्वोच्च न्यायालयाने निकाल सुनावला असून आरक्षण रद्द केले आहे.
\nसकाळी १०.३० वाजता सर्वोच्च न्यायालयात सुनावणी सुरु झाली. यावेळी सर्वोच्च न्यायालयाने गायकवाड समितीचा अहवाल अस्वीकारार्ह असल्याचे सांगितले. मराठा आरक्षण देणे गरजेचे वाटत नसून सध्याच्या परिस्थितीत आरक्षण देणे शक्य नसल्याचे सांगितले आहे.

“माझ्यासाठी आणि समाजासाठी अतिशय दुर्दैवी क्षण आणि अतिशय भयानक क्षण आहे. सुप्रीम कोर्टाने आम्ही एकत्ररित्या निर्णय देत असल्याचं स्पष्ट केलं आहे. मुबंई हायकोर्टाने दिलेला निर्णय आणि मागास आयोगाचा रिपोर्ट याच्यातून आम्हाला मराठा आरक्षण देणं गरजेचं आहे हे स्पष्ट होत नाही. तसंच इंद्रा सहानी खटल्याबाबत पुन्हा एकदा तपासणी करण्याची गरज आम्हाला वाटत नाही यामुळे मराठा आरक्षण आम्ही रद्द करतोय असे स्पष्ट मत सर्वोच्च न्यायालयाने दिलेले आहे. या दुर्दैवी निर्णयामुळे महाराष्ट्रात स्थगित असलेलं मराठा आरक्षण थांबलं आहे,” अशी माहिती याचिकाकर्ते विनोद पाटील यांनी पत्रकार परिषदेत दिली.
\n“सुप्रीम कोर्टाच्या निर्णयाविरोधात बोलायचं नाही, पण हा निर्णय दुर्दैवी आहे. याचा परिणाम संपूर्ण तरुण पिढीवर होणार आहे. सविस्तर ऑर्डर आल्यानंतर वकिलांशी चर्चा करुन समाजाच्या, तरुणांच्या वतीने पुढील निर्णय घेतला जाईल,” असे त्यांनी सांगितले.
