स्वयंसेवी संस्थ्या ओडिशा विकास परिषदेकडून ही याचिका करण्यात आली होती. याचिकेत म्हटलं आहे की, “१० ते १२ दिवस चालणाऱ्या या रथयात्रेसाठी जवळपास १० लाख लोक उपस्थित राहण्याची शक्यता आहे. जर ही रथयात्रा पार पडली तर लाखो लोकांना संसर्ग होण्याची भीती आहे”. याचिकेत ओडिशा सरकारनेही राज्यात ३० जूनपर्यंत धार्मिक कार्यक्रमांवर बंदी घालण्यात आल्याची माहिती दिली आहे.
\nअॅटर्नी जनरल मुकूल रोहतगी यांनी ओडिशा विकास परिषदेची बाजू मांडताना, रथयात्रेला परवानगी दिल्यास सरकारच्या आदेशाचं उल्लंघन होईल असा युक्तिवाद केला. सरन्यायाधीश शरद बोबडे यांनी ही गंभीर बाब असल्याचे मत यावेळी नोंदवले. रथयात्रेसाठी १० हजार लोक जरी आले तरी गंभीर गोष्ट आहे असे यावेळी त्यांनी सांगितले.
